Terms of Use

1. Acceptance of Terms

By accessing or using Recense ("Service"), you agree to be bound by these Terms of Use. If you do not agree with any part, please do not use the Service.

2. User-Generated Content (UGC)

2.1 Content Responsibility

When you create, upload, or share a flashcard deck ("Content") on Recense, you are the sole party responsible for the legality, accuracy, and appropriateness of that Content.

2.2 License to Platform

By posting Content to the Service, you grant Recense a non-exclusive, royalty-free, worldwide license to store, display, distribute, and permit other users to view that Content within the Service. This license terminates when you delete the Content or your account.

2.3 Prohibited Conduct

  • Posting Content that infringes the copyright, trademark, trade secret, or other intellectual property rights of any third party.
  • Posting pornographic, violent, discriminatory, or unlawful content.
  • Spamming, distributing malware, or intentionally disrupting the Service.
  • Impersonating or deceiving other users.

3. Copyright and Takedown Policy

Recense respects intellectual property rights and complies with the notice-and-takedown process under DMCA §512 (United States) and Decree 17/2023/ND-CP (Vietnam). If you believe Content on the Service infringes your copyright, please see the DMCA page for the notice procedure.

4. Repeat Infringer Policy

Recense maintains and enforces a policy of terminating accounts of repeat infringers. Specifically:

  • Each time a deck is removed for copyright or policy violation, the deck owner receives 1 strike.
  • After 3 strikes, the account is flagged for review for suspension or termination.
  • Suspension/termination decisions are made by the Recense team, taking into account context and severity of violation.

The repeat infringer policy is enforced in practice, not just on paper. Recense reserves the right to review and act on violating accounts at any time.

5. User Accounts

You are responsible for maintaining the security of your login credentials. Recense is not liable for losses due to unauthorized access to your account. We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

6. Limitation of Liability

The Service is provided "as-is." Recense does not warrant continuity, accuracy, or fitness for a particular purpose. To the extent permitted by law, Recense is not liable for indirect, special, or consequential damages.

7. Changes to Terms

Recense may update these terms. Material changes will be communicated via email or Service notification. Continued use after a change constitutes acceptance of the new terms.
